The relief sought for in the present Writ Petition is to direct the respondents to appoint the petitioner on compassionate ground in the respondent Department.

2. The husband of the petitioner one Saravanakumar Rajagopal was working in the Education Department as Teacher and died on 22.01.2018 in a road accident while he was in service.

3. The learned Additional Government Pleader relied on the counter affidavit made a submission that the petitioner has not submitted all the required documents for the purpose of scrutinizing her case in accordance with the scheme of compassionate appointment.

4. This Court is of the considered opinion that all the relevant records and the relevant documents to be produced by the petitioner are to be considered for the purpose of providing compassionate appointment under the scheme. When the petitioner has not produced all the documents, the respondents may not be in a position to consider the case of the writ petitioner.

5. Thus, the petitioner is at liberty to submit all relevant documents including no objection certificate and establish her legal heirship etc., before the respondents. In the event of establishing her right for compassionate appointment, it is to be considered by the Competent Authority in consonance with the terms and conditions of the scheme.
