PRAYER : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondents to consider the petitioner for promotion to the post of Deputy Tahsildar taking into consideration of the petitioner's seniority in the cadre of Assistant from the year 2012 in strict compliance with the order dated 28.03.2018 passed in W.P.(MD)No.4553 of 2018 within the period that may be stipulated by this Court.

ORDER

This petition has been filed to direct the respondents to consider the petitioner's promotion to the post of Deputy Tahsildar taking into consideration of the petitioner's seniority in the cadre of Assistant from the year 2012, in the light of the order passed in W.P.(MD)No.4553 of 2018 dated 28.03.2018.

2.The petitioner has preferred writ petition in W.P.(MD)No.4553 of 2018 to direct the respondents to include the petitioner's name in the notional panel of the assistant drawn for the year 2012 in Dindigul 2/5

District. This Court vide order dated 28.03.2018, allowed the said petition holding that the petitioner should be given promotion by including his name in the panel of the promotion in the year 2012. Since the official respondents have not complied with the order passed by this Court, the petitioner has filed contempt petition in Cont.P.(MD)No.1333 of 2018 and the same is pending for adjudication. 3.The learned counsel on either side fairly conceded that against the order passed in W.P.(MD)No.4553 of 2018 dated 28.03.2018, a writ appeal has been filed in W.A.(MD)No.224 of 2019 by the Government and the same is pending.

4.In view of the above, nothing survives in this writ petition for further adjudication and therefore, this writ petition is closed. No costs. Consequently, connected miscellaneous petitions are closed. NCC : Yes / No 24.02.2025 Index : Yes / No gns 3/5
