Acquisition, Rehabilitation Act, 2013 for the acquisition of land to an extent of 11 cents in S.No.543/1A of Madhavan Kurichi Village, Tiruchendur Taluk, Thoothukudi District by considering the representation of the petitioner dated 29.01.2025 within a time frame that may be fixed by this Court.

O R D E R

Heard Mr.P.Thinesh, leaned Counsel for the petitioner and Mr.M.Lingadurai, learned Special Government Pleader appearing for the respondents.

2.The petitioner seeks compensation including solatium for the properties acquired from the petitioner namely 11 cents in S.No.543/1A of Madhavan Kurichi Village, Tiruchendur Taluk, Thoothukudi District. The petitioner also seeks for alternate residence in terms of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation Act, 2013. The petitioner has given a representation on 29.01.2025, in this regard. 2/6

3.The learned Special Government Pleader, on instructions submits that the compensation payable to the petitioner has already been deposited before the Principal District Court, Tuticorin. The copy of the cheque dated 17.04.2025, is also produced before this Court to substantiate the said contention. As regard the alternate lands sought for by the petitioner, learned Special Government Pleader submits that the said representation would be disposed of, on merits.

4.In view of the above, giving liberty to the petitioner to move for payment of compensation deposited before the Principal District Court, Tuticorin, besides also exercising his claim for enhanced compensation in accordance with law, the said part of the prayer is addressed. Insofar as the alternate lands sought for by the petitioner, the third respondent shall consider the petitioner's representation dated 29.01.2025, after affording personal hearing to the petitioner and pass orders on merits and in accordance with law within a period of twelve [12] weeks from the date of receipt of a copy of this order.

5.Accordingly, this Writ Petition stands disposed of. There shall be no order as to costs.
