PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the first respondent to direct the fourth respondent to cancel the forged Patta No.2888 of Vaiyampatty Village, Manapparai Taluk, Trichy District, based on the petitioner's representations dated 14.02.2023 and 05.04.2023, within a time limit as fixed by this Court. ORDER

This Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the first respondent to direct the fourth respondent to cancel the forged Patta No.2888 of Vaiyampatty Village, Manapparai Taluk, Trichy District, based on the petitioner's representations dated 14.02.2023 and 05.04.2023, within a time limit as fixed by this Court.

2. Heard the learned counsel appearing for the parties.

3. According to the petitioner, the Patta relating to the subject property originally stands in the name of his father and his father died on 03.06.2021. Subsequently, the seventh respondent obtained Patta No.2888 relating to the land in Vaiyampatty Village, Manapparai Taluk, Trichy District, which is a forged one and has been illegally created without any lawful entitlement. Upon coming to know about the forgery, the petitioner made detailed representations on 14.02.2023 and 05.04.2023 to the first respondent, requesting appropriate action for cancellation of the forged patta. Despite the petitioner's representations, the authorities have failed to initiate any enquiry or take steps, resulting in continued prejudice to the petitioner. Hence, the present Writ Petition.

4. The learned Government Advocate for the respondents 1 to 5 submits that the petitioner's representations will be considered on its merits and in accordance with law.

5. Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the second respondent to consider the petitioner's representations dated 14.02.2023

and 05.04.2023, on merits and in accordance with law and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order. The representation shall be considered and disposed of after conducting an enquiry. The second respondent is directed to provide reasonable opportunity during such enquiry to the petitioner and also to the other persons, who may be affected by such decision. There shall be no order as to costs. Consequently, connected Miscellaneous Petitions are closed. NCC : Yes / No (K.SURENDER, J.)
