O R D E R

This Transfer Civil Miscellaneous Petition has been filed by the Petitioner/Wife to withdraw the case in H.M.O.P.No.5 of 2025 pending on the file of the Subordinate Court, Sattur and transfer the same to the file of Family Court, Madurai.

2.Heard Mr.A.Subramanian, learned counsel for the petitioner and Mr.N.Tamilmani, learned counsel for the respondent. 3.The Co-ordinate Bench of this Court, vide order dated 23.06.2025, referred the matter to the Mediation and Conciliation Centre attached to this Bench. In compliance with the direction issued by the Co-ordinate Bench of this Court, the Mediation and Conciliation Centre attached to this Bench filed its report dated 24.07.2025, stating that the mediation was completed and an agreement was entered into between the parties on 24.07.2025. The terms of the agreement dated 24.07.2025 are reproduced herein below:- 2/7

"6.The Following settlement has been arrived between the parties hereto A. Both Parties agreed for getting decree of divorce by Mutual Consent B. The Respondent/husband agreed to withdraw HMOP.No.5/2025 pending on the file of the Sub Court, Sattur. C. The Petition/Wife agreed to withdraw HMOP.No. 123/2025 pending on the file of the Sub Court, Thirumangalam. D. Both Parties agreed to file a Petition for divorce by mutual consent before the Sub Court, Thirumangalam at the cost of the Petitioner/Wife for filing within a period of two weeks from today. The Respondent/Husband agreed to Cooperate for the early disposal of said divorce by mutual consent case.

E. The Respondent/Husband received his golden ring weighing 4 grams and golden Mangalyam 4 grams from the Petitioner/Wife today before the Mediation and Conciliation centre Madurai.

F. The Petitioner/Wife had already taken all her golden jewels, Utensils and furniture's etc. Which were given to her at the time of her marriage by her parents from the Matrimonial house. Hence the Petitioner/Wife has no claim against the Respondent/Husband regarding the articles.

G. The Petitioner/Wife assured that she will not claim any past, present and future maintenance form the 3/7

Respondent /Husband. The Respondent/Husband also assures he is also having no claim against the Petitioner/Wife. H. Both Parties agreed not to interfere with the life of each other here after.

I. For the above said reasons the Petitioner/Wife have no Objection to dispose the above TRCMP(MD).No.292/2025 pending before this Hon'ble Court.

7. By signing this Agreement the Parties hereto state that they have no further claims or demands against each other with respect to TRCMP(MD). No.292/2025 (Case No) and all disputes and differences in this regard have been amicably settled by the Parties hereto through the process of conciliation/Mediation."

4.Today, when the matter is being taken up, Mr.A.Subramanian, learned counsel for the petitioner and Mr.N.Tamilmani, learned counsel for the respondent submit that both the parties have entered into compromise and settled the matter amicably, in terms of the agreement entered into between them dated 24.07.2025. Thus, they pray this Court that the present Transfer Civil Miscellaneous Petition may be disposed of, in terms of the agreement entered into between the parties, dated 4/7

24.07.2025, as now there is no cause of action exists in the present Transfer Civil Miscellaneous Petition.

5.Accordingly, after considering the arguments as advanced by the learned counsel for the parties and after perusal of the mediation report filed by the Mediation and Conciliation Centre attached to this Bench, dated 24.07.2025 as well as the settlement agreement entered into between the parties, dated 24.07.2025 and also considering the fact that the parties have entered into compromise, this Court deems it appropriate that no useful purpose would be served by keeping this Transfer Civil Miscellaneous Petition pending before this Court, as now there is no cause of action exists in the present Transfer Civil Miscellaneous Petition.

6.Accordingly, this Transfer Civil Miscellaneous Petition is finally disposed of, in terms of the agreement entered into between the parties, dated 24.07.2025. It is made clear that both the parties are directed to abide by the conditions stated in the agreement dated 24.07.2025. The 5/7

file is consigned to record. No costs. Consequently, connected Miscellaneous Petition is closed.
