O R D E R

This petition has been filed to direct the second respondent to provide adequate police protection to the petitioner for his life and limb against the third respondent at the time of doing agricultural works in his own land situated in S.Nos.249/8 of Agaram Village, Alangulam Taluk, Tenkasi District on the basis of the petitioner's representation dated 18.06.2021.

2. The case of the petitioner is that she purchased the property situated in S.No.249/8 of Agaram Village, Alangulam Taluk, Tenkasi District, by way of sale deed and she is in possession and enjoyment of the property. But the third respondent has fabricated the settlement deed for the above said property in his name. When the petitioner went to cultivate in the property, trouble was made by the private respondents. On that basis, she made a representation on 05.08.2019 seeking police protection.

3. The learned Additional Public Prosecutor would submit that it is a property dispute between the petitioner and the third respondent herein, who is none other than the brother of the petitioner. On the basis of the complaint given by this petitioner, enquiry was undertaken and during the course of enquiry, the petitioner herself has given a statement to the effect that she will work out her remedy before the Civil Court and the complaint was closed on 18.07.2021. He would further submit that the father of the parties namely Subbaiya also appeared before the Enquiry Officer and he has also given a statement to the effect that he settled the property in favour of his son. But, at that time, this petitioner did not make any claim. After some time, she created problem by making claim. On that ground, a trouble arouse between the parties.

4. Since the representation was closed, she has to work out her remedy as per the law before the Civil Court and the question of granting police protection does not arise. Hence, this Criminal Original Petition stands disposed of.
