COMMON ORDER : The Court made the following order :- Crl.O.P.(MD)No.6965 of 2024 has been filed by the petitioners apprehending arrest at the hands of the respondent Police in connection with a case in Crime No.235 2/5
of 2024 for the offence punishable under Sections 147, 148, 294(b), 436, 427 and 506(ii) IPC and Section 3 of Tamil Nadu Public Property (Prevention of Damage & Loss) Act, 1992 and Section 3 of Explosive Substances Act, 1908.
2. Crl.O.P.(MD)No.6967 of 2024 has been filed by the petitioners apprehending arrest at the hands of the respondent Police in connection with a case in Crime No.33 of 2024 for the offence punishable under Sections 147, 435 IPC r/w. Sections 3 and 4 of Tamil Nadu Public Property (Prevention of Damage & Loss) Act, 1992.
3. Crl.O.P.(MD)No.6990 of 2024 has been filed by the petitioners apprehending arrest at the hands of the respondent Police in connection with a case in Crime No.237 of 2024 for the offence punishable under Sections 147, 148, 294(b), 323, 307 & 506(ii) IPC.
4. The petitioners, who are offenders, have involved in transporting essential commodities from ration shops. There was a previous enmity between the first petitioner, namely, Karthik Raja @ Pambu Karthick and one Chinnajameen, who is the brother of the defacto complainant in Crl.O.P.(MD)No.6965 of 2024. The petitioners, with an apprehension that the said Chinnajameen has intimated about their acts to the respondents Police, are said to have thrown a country made bomb on his house, his farm and damaged the vehicle. The said incident was witnessed by one Kathiresan, who was also attacked by the petitioners. 3/5
5. The learned counsel appearing for the petitioners submits that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. However, they have been falsely implicated in these cases. Therefore, he prays for grant of anticipatory bail to the petitioners.
6. The learned Government Advocate (Crl. Side) appearing for the respondents police submits that as against the petitioners, several criminal cases have been registered under Essential Commodities Act.
7. Considering the nature of offence, the nature of allegations and also considering the antecedent of the petitioners, this Court is not inclined to grant anticipatory bail to the petitioners.
