ORDER

The Transfer Civil Miscellaneous Petition is filed to withdraw the Appeal suit in A.S.No.24 of 2012, on the file of the Sub Court, Sivakasi in O.S.No.236 of 2009, on the file of the Learned District Munsif Court, Sivakasi, to the file of Sub Court, Periyakulam, Theni District.

2.The learned counsel for the respondent submitted that already the first appeal in A.S.No.24 of 2012, on the file of the Sub Court, Sivakasi was dismissed as withdrawn and the same is not pending. Hence, nothing survives in the Transfer Civil Miscellaneous Petition.

3.Accordingly, the Transfer Civil Miscellaneous Petition is dismissed. No costs. Consequently, connected miscellaneous Petition is dismissed.
