O R D E R
This writ petition has been filed by the petitioner to direct the 1st respondent to issue C.S.R for the complaint preferred by the petitioner on 09.04.2025 and consequently, to direct the 1st respondent to relegate the issue to the 2nd respondent for conducting peace committee meeting.
2. The learned counsel appearing for the petitioner would submit that the petitioner is the elected executive committee member of the Mahaideen Andavar Jumma Pallicasal, Thuvarankurichy and the period of the committee started on 26.02.2022 and end on 25.06.2025. The committee applied for sanction from the Tamil Nadu Wakf Board in the year 2022, seeking permission to construct 12 shops in the land belonging to Jamath. The permission was also accorded by the Tamil Nadu Wakf Board on 20.03.2025. Since the term of executive committee is about to Page No. 2 of 5
expire on 25.06.2025, it is not possible to complete the construction work within the term of the office bearers. The above said construction work was deferred till the next executive committee is elected. But 6 of the executive committee members wanted to construct the shops without following the guidelines issued by the TN Wakf Board. Therefore, the petitioner lodged a complaint before the 1st respondent on 07.04.2025 and they not even issued C.S.R for the complaint. Therefore, he has filed this petition.
3. The learned Government Advocate (Criminal Side) appearing for the respondents no.1 would submit that based on the complaint lodged by the petitioner, they referred the matter to the 2nd respondent for conduct of peace committee meeting and now the same is pending with the 2nd respondent.
4. The learned Government Advocate appearing for the 2nd respondent would submit that the 1st respondent has referred the matter to the 2nd respondent along with the complaint preferred by the petitioner and the same is under consideration. They will conduct peace committee meeting with all the interested parties and they will take appropriate Page No. 3 of 5
decision in accordance with law.
5. Mr.S.Abduthaheer, learned counsel represented that the petitioner without impleading the contested respondent, has filed this petition, therefore he seek adjournment to file the implead petition.
6. The prayer sought for in the petition is against the respondents no. 1 and 2 to issue C.S.R and they referred the matter for conduct of peace committee meeting. Therefore, the impleadment of the respondents will not arise in this case. However, it is for the 2nd respondent to issue notice to all the interested parties including all the secretary for the Mahaideen Andavar Jumma Pallicasal, Thuvarankurichy. Therefore, recording the above said submissions of the learned Government Advocate, this writ petition is closed.
