...RESPONDENT/RESPONDENT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to relax the condition of appearing before the Learned Judicial Magistrate No.I, usilampatti, Madurai District., on the first working day of every week at 10.30 a.m., imposed on the petitioner in Crl MP(MD) No.1230/2022 in Crl RC(MD) No.823/2022 pending disposal of the main criminal revision petition. Prayer in CRL RC(MD). 823/ 2022 :
To call for the records relating to the impugned judgment dt.17.12.2021 passed by the Learned V Additional District and Sessions Court,Madurai in CA.No.169 of 2017 confirming the conviction and sentence passed by the Learned Judicial Magistrate No.I,Usilampatti in CC.No.51 of 2013 dated 06.01.2017 and set aside the same by allowing the revision petition.
Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.SELVAM.J, Advocate for the petitioner and of MR.A.ALBERT JAMES, Government Advocate (Criminal Side) on behalf of the Respondent, the court made the following order:- The above petition has been filed to relax the condition imposed against the petitioner in Crl.M.P.(MD)No.10230 of 2022 in Crl.R.C.(MD)No.823 of 2022 dated 19.09.2022.
2. The learned Government Advocate (Criminal Side) appearing for the respondent would submit that the petitioner is complying with the condition from 10.04.2023 to 12.06.2023. https://www.mhc.tn.gov.in/judis 1/2

The learned counsel appearing for the petitioner would submit that the petitioner has surrendered on 26.09.2022 and started to comply with the condition from 03.10.2022, but the concerned Court has misplaced the notebook and on their instructions, the petitioner started to sign in the new notebook from 10.04.2023 to 12.06.2023.
4. Considering the above, the condition is modified and the petitioner is directed to appear before the concerned Court, once in a month i.e., on the first working day of every English calendar month at 10.30 a.m., until further orders. Accordingly, this Criminal Miscellaneous Petition is ordered.
