O R D E R

This petition is filed to direct the second respondent to give adequate police protection to the petitioner's life and limb, on the basis of the petitioner's representation, dated 10.07.2021. 2.It is brought to the notice of this Court that both the petitioner and the private respondent are the close relatives called 'pangalies' and due to sharing of well water, there a dispute arose between them.

3.When the matter taken up for hearing, the learned Government Advocate (Crl.Side) has circulated a copy of the Closure Report. It is seen that based upon the complaint made by the petitioner, enquiry was undertaken in C.No.16616 of 2021. During the course of enquiry, both the parties appeared and the third respondent given a statement to the effect that he will not make any threat and pressure upon the petitioner to withdraw the complaint. After the above said occurrence, he and his family members vacated the village and now they are residing in some other place. Only on the basis of fear, such a complaint has been given. Crl.OP(MD)No.9493 of 2021 given a statement to the effect that he will not make any trouble in future. So, this statement of the third respondent was accepted by the petitioner. Based upon the statement given by both the parties, it came to be closed on 27.07.2021.

4.Let a copy of the statement as well as the Closure Report be circulated to the learned counsel for the petitioner as well as the third respondent.

5.In view of the undertaking given by the third respondent, nothing survives in this petition for further direction. Recording the undertaking given by the third respondent, this Criminal Original Petition is disposed of.

6.If any trouble arises in future, the petitioner is at liberty to approach the second respondent to make proper representation, if any violation of undertaking given by the third respondent is noticed.
