PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the fourth respondent to re-fixation of selection grade pay with effect from 20.01.2009 FN in the post of Assistant Executive Engineer with consequential monetary benefits till date based on the petitioner's representation dated 07.11.2013 within the time that may be stipulated by this Court.

O R D E R

This Writ Petition has been filed for a Mandamus seeking for a direction to the fourth respondent to refix the selection grade pay for the petitioner with effect from 20.01.2009 in the post of Assistant Executive Engineer with consequential monetary benefits.

2. A counter affidavit has been filed by the respondents and in Paragraph Nos.5 and 6, they have categorically stated that the prayer of the petitioner for refixation of selection grade pay with effect from 20.01.2009 in the post of Assistant Engineer has been complied with subsequent to the filing of this Writ Petition. The said submission is recorded.

3. In case, the respondents are liable to pay the petitioner pursuant to the refixation of his selection grade pay with effect from 20.01.2009, they shall pay the said amount to the petitioner within a period of twelve weeks from the date of receipt of a copy of this order.

4. With the aforesaid direction, the Writ Petition stands disposed of. No costs.
