Criminal Original Petition is filed under Section 438 of Criminal Procedure Code, praying this Court to enlarge the Petitioner on Bail in the event of his arrest in connection with the case in Crime No.Not Known of 2021 on the file of the Respondent Police.

ORDER:- Criminal Original Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.A.Vinu Sarath, Advocate for the Petitioner and of Mr.T.Senthilkumar, Government Advocate (Criminal Side) on Behalf of the Respondent, this Court made the following order:

The petitioner is apprehending arrest at the hands of the respondent Police for the offences punishable under Sections 406, 420 and 506(1) of IPC in Crime No.Not Known of 2021.

2. The learned counsel for the petitioner seeks permission of this Court to withdraw the petition.

3. This Court passed an order on 19.07.2021, in which, paragraph 4 reads as follows:

"4.Considering the facts and circumstances, the respondent Police is directed to conduct the enquiry and if any prima facie made out against the petitioner, register the F.I.R or close the petition enquiry within a period of two weeks from the date of receipt of a copy of this order."

4. Even today ie., 23.08.2021, the learned Government Advocate 1/2

CRL OP(MD). No.9467 of 2021 (Criminal Side) submits that petition enquiry is still pending. Subsequent to the earlier order dated 19.07.2021, this Court passed an order on 13.08.2021, wherein, paragraph 3 reads as follows: "Considering the nature of allegations levelled against the petitioner, this Court is inclined to grant interim anticipatory bail to the petitioner for a period of one week. The petitioner is directed to appear before the respondent police daily and co-operate with the investigation."

5. The respondent Police is directed to be present before this Court along with files in this case on 26.08.2021.

6. Post the matter on 26.08.2021.
