PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the respondents to release the crop insurance amount for the period of 2018-2019 to the petitioner by considering the petitioner's representation dated 01.07.2024.

O R D E R

I heard Mr.S.Malaikani for the petitioner, Mr.S.Shaji Bino, learned Special Government Pleader for the respondents 1 to 3 and Mr.D.Srinivasa Ragavan, learned counsel for the fourth respondent.

2. The petitioner is an Agriculturist. During the financial year 2018-2019, he suffered damage to his crop. The petitioner 2/6

had taken an insurance for the said crop through the office of the third respondent. Despite the failure of the crop, the insurance amount was not paid. On verification, the petitioner came to know that instead of registering the damage as 'Vellamarichukatti Village', it had been wrongly entered as 'Kalari Village'. On account of the mismatch in the name of the Village, the insurance amount was not paid.

3. I had an occasion to consider the very same issue in W.P(MD).No.3871 of 2023, dated 25.02.2025. In case of wrong entry of revenue village, the Government of Tamil Nadu had issued an order in G.O.(Ms).No.141 of Co-operation, Food and Consumer Protection (CGI) Department, dated 30.12.2021. In terms of the Government Order, a corpus fund was created. If on account of some error, which has crept in by uploading the details, the claim is rejected, the Government had directed that the farmers would be paid out of the corpus fund. The appropriate authority for the said purpose being the District Collector. 3/6

4. The facts of this case being similar to the order passed in W.P(MD).No.3871 of 2023, this Writ Petition is ordered. The first respondent /District Collector shall verify the details of damage suffered by the petitioner and take all steps necessary in terms of G.O.(MD).No.141 and ensure that the petitioner is paid the amount within a period of four (4) weeks from the date of receipt of a copy of this order.

No costs.
