ORDER : The Court Made the following order :- The petitioner/A4 apprehends arrest at the hands of the respondent police for the offences punishable under Sections 406, 408, 409, 420, 465, 468, 471,477(A), 120(b) and 109 of I.P.C., in Crime No.4 of 2018, seeks anticipatory bail.
2.The case of the prosecution is that whem auditing was conducted in Anjukottai Co-operative Society, Anjukottai, Thiruvadanai Taluk, Ramanathapuram District for the period from 14.04.2015 to 28.02.2019, it was found by the auditing authorities that there was malpractices and misappropriation of society fund. Hence, the Deputy Registrar of Co-operative Society has filed the complaint before the respondent police.
3.Heard the learned counsel appearing for the petitioner, who would submit that the petitioner is working only as an Appraiser in the said society and he has been working there as temporary employee and he has no way connected with the occurrence. 4.The learned Additional Public Prosecutor appearing for the respondent submitted that investigation is pending. 5.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is directed to deposit a sum of Rs.4,00,000/- (Rupees four lakhs) to the credit of https://hcservices.ecourts.gov.in/hcservices/
crime No.4 of 2018 on the file of the respondent police before the learned Judicial Magistrate No.1, Ramanathapuram and on such deposit, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.1, Ramanathapuram and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.30 a.m. for a period of two weeks and thereafter, as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously. 6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
