PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the first respondent to initiate revenue recovery proceedings against the second respondent to recover the amount of Rs.9,10,520/- with 12% interest as per award, dated 12.04.2017, passed in W.C.No.102/2016 on the file of the third respondent.

This writ petition is filed for writ of Mandamus, to direct the first respondent to initiate revenue recovery proceedings against the second respondent to recover the amount of Rs.9,10,520/- with 12% interest as per award, dated 12.04.2017, passed in W.C.No.102/2016 on the file of the third respondent.

2. The petitioner was working in the 2nd respondent company. The petitioner met with an accident and filed a petition before the 2nd respondent under Workman Compensation Act. The 3rd respondent passed an award, dated 12.04.2017, directing the 2nd respondent to pay a sum of Rs.9,10,520/- with 12% interest. Since the 2nd respondent has not paid the same, the petitioner has requested the District Collector, Pudukottai, to invoke Revenue Recovery Act and recover the said amount from the 2nd respondent and the pay the amount. Since the District Collector has not initiated any action, the petitioner is before this Court.

The learned Additional Government Pleader on instructions from the 1st respondent circulated a communication, dated 13.04.2023, wherein the District Collector, Pudukottai, has stated that the appropriate authority is District Collector, Tirupur. The 1st respondent has communicated the letter to the District Collector, Tirupur, since the 3/6
properties of the 2nd respondent is within the jurisdiction of the District Collector, Tirupur and requested the District Collector, Tirupur, to execute the award granted by the 3rd respondent. 4.The communication, dated 13.04.2023 is extracted hereunder: 5.Therefore this Court is suo motu impleading the District Collector, Tirupur, as 4th respondent in this writ petition. The 4th respondent is directed to invoke revenue recovery proceedings and take 4/6
appropriate action in accordance to law and the said proceedings shall be completed within a period of four months from the date of receipt of a copy of this order.
6.With the above said observation, the writ petition is disposed of. No costs.
