ORDER
Today, when the matter is taken up for consideration, the learned counsel for the petitioner seeks permission of this Court to withdraw this
Writ Petition with liberty to the petitioner to approach the jurisdictional Civil Court for the purpose of seeking declaration and for consequential reliefs. He has also made an endorsement to that effect.
2. Permission is granted. Accordingly, the Writ Petition stands dismissed as withdrawn with the aforesaid liberty. There shall be no order as to costs. If the petitioner pleads exemption from limitation under Order 7 Rule 6 of CPC, the Civil Court should number the plaint leaving open the issue of limitation to be tried at the time of trial. 28.04.2025 NCC :
