O R D E R
The Writ Petition is filed seeking a direction to the second respondent to complete the enquiry pending on his file in TN/REV/MDU/CollSpl/07APR25/11417279.
2.Heard the learned counsel appearing on either side and perused the materials placed before this Court. 3.According to the Petitioner, the subject property situated in old S.No.2142/3, New S.Nos.651/1, 651/2 and 651/3 in Ayyampatyti Village, Melur Taluk, Madurai District originally belonged to the Petitioner's grand-father Rasu Ambalam. The 2/6
Petitioner is the son of one Saminathan, who happens to to be the son of Rasu Ambalam, through his first wife Muthammal. It is further stated that Rasu Ambalam married one Amirthammal as second wife and respondents 4 to 6 were born to Rasu Ambalam through his second wife. The patta originally stood in the name of Rasu Ambalam and Amirthammal. After the death of Rasu Ambalam, respondents 4 to 6 obtained Patta Transfer Order in their favour suppressing the existence of other legal heirs of Rasu Ambalam. Challenging the said order, the Petitioner filed an appeal before the second respondent and also submitted an application to the Chief Minister's Special Cell. The same has not been considered till date. Hence the Petitioner has come before this Court with the present Writ Petition for the relief stated supra. 4.
Though the Petitioner sought for completion of the enquiry pending on the file of second respondent in Proceedings TN/REV/MDU/CollSpl/07APR25/11417279, the Petitioner has not produced any material to show that he submitted an appeal before the second respondent challenging the patta transfer order passed by the third respondent. Proceedings number mentioned by the Petitioner in the Writ payer is only a reference number given to the Petitioner's application submitted before the Chief Minister's Grievance Cell.
the proceedings number which is pending on the file of the second respondent, this Court is unable to issue any direction as prayed for.
5.Therefore, the Writ Petition stands dismissed, with liberty to the Petitioner to file a fresh Writ Petition giving the correct proceedings number, pending on the file of the second respondent. No costs. Consequently, connected Miscellaneous Petition is closed.
