PRAYER :- For Anticipatory Bail in Crime No.17 of 2024 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner, apprehending arrest at the hands of the respondent Police in 1/3

connection with a case in Crime No.17 of 2024, for the offence under Sections 11 and 12 of POCSO Act, seeks anticipatory bail.

2. The case of the prosecution is that in the year 2022, the petitioner was working as P.T. Teacher in a College, where, the victim girl was studying in second year. At that time, the petitioner has misbehaved with the victim girl and sexually harassed her. Hence, the case has been registered against the petitioner. After the registration of the case, the petitioner was suspended from service.

3. The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. However, he has been falsely implicated in this case. He further submits that the alleged occurrence is said to have taken place in the year 2022, but, the complaint has been given by the defacto complainant only in the year 2024. Therefore, this complaint is a false one. Therefore, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) opposes for grant of anticipatory bail on the ground that the investigation is yet to be completed. 2/3

5. Considering the nature of allegations, this Court is not inclined to grant anticipatory bail to the petitioner.
