ORDER

The petitioner has filed the present writ petition for issuance of Writ of Certiorari to call for the records pertaining to the impugned order dated 07.02.2024 passed by the 2nd respondent.

2. The grievance of the petitioner is that the 2nd respondent-temple is under the control of the Hindu Religious and Charitable Endowment Department and every year festival, the Mandagapadi was allotted to the writ

petitioner community viz., Devendra Kula Velalar, whereas this year, the petitioner community and other community were prevented to have the Mandagapadi. Presently, they have decided to perform the festival for this year. However, the 2nd respondent passed the impugned order dated 07.02.2024 and the Devendra Kula Velalar community was allotted to have the Mandagapadi on 17.05.2024 and subsequently, the 2nd respondent has also allotted the other community to have the Mandagapadi on the same day evening.

3. Learned counsel for the petitioner submits that 16.05.2024 (Thursday) is free and the said date has not been allotted to any other to have the Mandagapadi. Therefore, the said date may be allotted to the other community and the petitioner community may exclusively be allotted 17.05.2024 (Friday) to have the Mandagpadi.

4. The learned Additional Government Pleader after consulting with the 2nd respondent has agreed to allot the right of having Mandagapadi on 16.05.2024 (Thursday) for the Adi Dravidar community, 17.05.2024

(Friday) for the petitioner community viz., Devendra Kula Velalar and 18.05.2024 (Saturday) for the Arunthathiyar community.

Considering the submissions made by the learned Additional Government Pleader, the 2nd respondent is directed to allot the right of having Mandagapadi on 16.05.2024 (Thursday) for the Adi Dravidar community, 17.05.2024 (Friday) for the petitioner community viz., Devendra Kula Velalar and 18.05.2024 (Saturday) for the Arunthathiyar community. The Inspector of Police, Batlagundu, is also directed to monitor the same.

6. With the above directions, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petitions are closed. 08.05.2024 Note: Registry is directed to mark a copy of this order to The Inspector of Police, Batlagundu.
