PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus to direct the respondents No.1 and 2 to remove the unauthorized construction made by the fourth respondent on the land situated at S.F.Nos.134/24, 134/25 and 134/26, Thiruvudayarpatti Village, Thirupattur Taluk, Sivagangai District by considering the representation of the petitioner dated 20.03.2026 within a time frame fixed by this Court.

ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) The petitioner has filed the present Writ Petition seeking a direction to the respondents 1 and 2 to remove the alleged unauthorized construction made by the fourth respondent in respect of the land situated in Survey Nos.134/24, 134/25 and 134/26, Thiruvudayarpatti Village, Thirupattur Taluk, Sivagangai District, by considering the petitioner's representation dated 20.03.2026.

2.It is the case of the petitioner that the subject properties were originally classified as Natham poramboke and thereafter assignment pattas were issued in favour of one Sasikala, Kangavalli and the fifth respondent. Subsequently, the said Sasikala and Kangavalli executed gift settlement deeds in favour of their minor sons, namely respondents 3 and 4. It is further stated that the respondents 3 and 4 have commenced construction without obtaining any building plan approval from respondents 1 and 2. In this regard, the petitioner submitted a representation dated 20.03.2026 to the official respondents. Since the same has not been considered thus far, the petitioner has filed the present Writ Petition. 3.The learned Additional Government Pleader appearing for the first respondent submitted that the petitioner's representation would be considered and appropriate orders would be passed on merits and in accordance with law within the time stipulated by this Court. 3/6

4.In view of the above, this Court, without going into the merits of the claim made by the petitioner, directs the authority concerned to consider the petitioner's representation dated 20.03.2026 and pass appropriate orders on merits and in accordance with law, after affording due opportunity of personal hearing to the petitioner, the private respondents, as well as any other interested parties. Such exercise shall be completed within a period of three months from the date of receipt of a copy of this order. 5.With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
