O R D E R

This Criminal Original Petition has been filed to direct the first and second Respondents to provide adequate Police Protection to the Petitioner and his construction workers, while carrying out the plastering work/construction work of the Petitioner's Property in Plot No.28, Survey No.593/31 (Old Survey No.337/5) situated at 2nd Harijan Street, Annavasal Town Panchayat, Iluppur Taluk, Pudukottai District, on the basis of the representation of the petitioner dated 30.03.2022, within the time stipulated by this Court. 1/3

2.The learned counsel appearing for the petitioner has submitted that the petitioner is making construction in the land situated at Plot No.28, Survey No.593/31 (Old Survey No.337/5) situated at 2nd Harijan Street, Annavasal Town Panchayat, Iluppur Taluk, Pudukottai District. The respondents 4 to 7 are adjacent residents and they are giving trouble to the petitioner and prevent him from doing construction work. Earlier, the respondents 4 to 7 assaulted the construction workers and for which, the petitioner has already given a complaint. Inspite of the earlier complaint, the respondents 4 to 7 again giving trouble to the petitioner. Hence, seeking police protection this petition has been filed by the petitioner.

3.The learned Government Advocate (Crl.Side) has submitted that based on the earlier complaint given by the petitioner, a case in Crime No.535 of 2020, for the offences under Sections 294(b), 323, 506(2) IPC has been registered against the respondents 4 to 7. 4.I considered the matter in the light of the submissions made on either side. Perusal of records reveal the facts that there is a dispute between the petitioner and the respondents 4 to 7 and a complaint also given by the petitioner. However, again the respondents 4 to 7 are causing trouble to the petitioner and hence, the petitioner has filed representation dated 30.03.2022, seeking for police protection.

5.In view of the above, the second respondent police is hereby directed to consider the representation of the petitioner dated 30.03.2022 and take suitable action and if necessary, provide police protection 6.This Criminal Original Petition is disposed of on these terms.
