ORDER

The prayer sought for in the present Writ Petition is to direct the respondents to appoint the petitioner for the post of Security Guard available presently under General Category Quota.

2.It is the contention of the petitioner that he, based upon the recruitment notification, dated 09.11.2018, applied for the post of Security Guard through online application. After that, the respondents had also sent a call letter to the petitioner to attend physical test on 18.02.2019. After the completion of physical test, the respondents asked the petitioner to produce the original certificates for verification. It is the further contention of the petitioner that since the respondent had called upon the petitioner to produce the original certificates, it amounts that the petitioner has been selected for the said post. However, the respondents did not select the petitioner and his name did not find place in the final list. It is the specific submission of the petitioner that though the respondents have notified 19 vacancies, only two vacancies were reserved for OBC category and that 17 vacancies were allotted to be the general category. The learned counsel would further submit 2/5

that eight posts are still kept vacant. Hence, he prays to allow the writ petition.

3.Though the name of the learned counsel appearing for the first and second respondents was printed in the cause list, in spite of the case being listed, no one has appeared on behalf of the respondents to deny the contention made by the petitioner.

4.If the petitioner's contention is accepted then there are 8 vacancies yet to be filled, and naturally the non-inclusion of the petitioner's name in the final list needs to be explained. However, the petitioner did not submit any material before this Court to pass a positive direction. 5.In such view of the matter, without going to the merits of the matter, this Court deems it appropriate to give liberty to the petitioner to send representation to the respondents within a period of two weeks from the date of receipt of a copy of this order. If such representation is received, the respondents are directed to consider the same and pass orders according to his own merits within a further period of four weeks therefrom. 3/5
