ORDER

The above petition has been filed seeking orders to condone the delay of 731 days in filing the appeal, challenging the award dated 21.12.2023 passed in M.C.O.P.No. 1547 of 2021 on the file of the Motor Accident Claims Tribunal / Special Subordinate Court, Tirunelveli.

2. No representation for the first respondent.

3. Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the respondents 2 and 3.

4. The learned counsel appearing for the respondents 2 and 3 would submit that if the petitioner is waiving interest for those delay periods, they are having no objections to condone the delay and he has also made an endorsement to that effect.

5. The learned counsel appearing for the petitioner would also agree for the same.

6. Considering the above, this Court is inclined to condone the delay. Accordingly, this petition is ordered and the Registry is directed to number the appeal, if it is otherwise in order. The petitioner / claimant is not entitled to interest for the delayed period.
