Respondents PRAYER:-Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a WRIT OF CERTIORARIFIED MANDAMUS, calling for records pertaining to the Impugned Order passed by 3rd respondent in Ref.No. Nil dated 26.02.2026 in so far as refusing to provide alternative employment, quash the same and consequently directing the respondents to forthwith provide suitable alternative employment to the petitioner on permanent basis at Aravakurichi or Manapparai or Cantonment Branches of 1st Respondent corporation by considering his severe heart disease and post him in any suitable post with light duty along with pay protection, continuity of service and back wages from the date of
disengagement i.e from 20.12.2023 to till the date on which the petitioner was provided with permanent alternative light duty in accordance with Section 20(4) of the Rights of the Persons with Disabilities Act, 2016 within a time frame that may be fixed by this Court.

ORDER
This writ petition has been filed challenging the proceedings dated 26.02.2026 issued by the third respondent intimating the petitioner that he is not the competent authority for providing an alternative employment pursuant to the recommendation of the Medical Board and requiring the petitioner to approach the competent authority.

When the matter is taken up for consideration, Mr.S.C.Herold Singh, learned Standing Counsel fairly submitted that the third respondent ought not to have simply rejected the request of the petitioner and the same would be forwarded to the competent authority for providing an alternative employment in accordance with law. He also submitted that the matter may be remanded back for fresh consideration.
3. In the light of the above, without going into the merits of the
matter, the impugned proceeding dated 26.02.2026 is hereby quashed and the matter is remanded back to the third respondent with a further direction to the third respondent to forward the same to the second respondent, who is stated to be competent authority for passing appropriate orders for providing an alternative employment to the petitioner in accordance with law. The second respondent is directed to pass appropriate orders as expeditiously as possible at any rate within a period of two weeks from the date of submission by the third respondent. Insofar as the claim of the petitioner for wages for the relevant period, the same is left open to the petitioner to challenge the same separately.
