PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Habeas Corpus, directing the respondent Nos. 1 to 3 to produce the person or body of the petitioner's daughter by name Chithradevi, daughter of Muthiayah, aged about 16 years before this Court and hand over the custody of the detenu to the petitioner. O R D E R

[Order of the Court was made by R.N.MANJULA, J.] This Habeas Corpus Petition has been filed by the mother of the detenu seeking to produce her daughter namely Chithradevi, daughter of Muthiayah, aged about 16 years, before this Court.

2. Heard Mr.R.Alagumani, learned counsel appearing for the petitioner and Mr.RMS.Sethuraman, learned Additional Public Prosecutor appearing for the respondents 1 to 3.

3. As per the earlier order dated 15.05.2024, the detenue was secured and the 4th respondent was arrested by the respondent police. Today the detenue and the 4th respondent are produced before this Court. The parents of the detenue also present before this Court. It appears that the detenue and the 4th respondent had developed love affair and due to which the detenu had eloped with the 4th respondent and thereafter both of them were living together without informing the detenue's parents. On enquiry, the detenu stated that she was compelled by her parents to marry her maternal uncle and so she opted to go with the 4th respondent. But the parents now realized their mistake and they have given an undertaking that they would do the needful to continue the studies of the detenue.

4. Recording the said statement of the parents, the custody of the detenue is handed over to the parents who are present today in the Court.

5. In view of the above, this Habeas Corpus Petition is closed.
