Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorari calling for the records of the respondent in impugned charge memo, dated 4.6.2018 in Ku.Aa.No.001558/0116/Ni.bi.bi/B1/Go.O.N/2018/3 and to quash the same as illegal and arbitrary. ORDER

The Petitioner has come forward with this Writ Petition seeking a direction to call for the records of the respondent in impugned charge memo, dated 4.6.2018 in Ku.Aa.No.001558/0116/Ni.bi.bi/B1/Go.O.N/2018/3 and to quash the same as illegal and arbitrary.

2.Mrs.S.Srimathy, learned Special Government Pleader takes notice for the respondent. By consent of both parties, the main Writ Petition itself is taken up for final disposal at the admission stage itself.

3.According to the Petitioner, the incident based on which the charge-memo has been issued, has not been taken place and the Petitioner has also been subsequently promoted and presently, he is working in Thiruvarur. The above incident said to have been taken place in Gandharvakkottai. Whether the alleged incident has taken place or not is a matter for enquiry, as there is a complaint and counter complaint and this Court cannot go into all those aspects. Hence this Court is not inclined to quash the charge-memo, as sought for by the Petitioner. https://hcservices.ecourts.gov.in/hcservices/

4.Accordingly, the Writ Petition stands dismissed, with observation that the enquiry with regard to the charge-memo shall be conducted on day-to-day basis, without adjourning the matter beyond seven days at any point of time. No costs. Consequently, connected Miscellaneous Petition is dismissed.
