ORDER

This writ petition has been filed seeking a writ of mandamus to direct the respondents to reimburse the medical expenses for sum Rs.4,21,907/- with interest under the medical reimbursement scheme by considering the petitioner's representation dated 16.03.2026 within the time period stipulated by this Court.

The claim of the petitioner for reimbursement of medical expenses is in terms of the New Health Insurance Scheme, 2022 introduced for pensioners and family pensioners through G.O.(Ms.)No. 204, Finance (Health Insurance) Department dated 30.06.2022. The claim of the petitioner was not fully admitted by the fourth respondent and the same is pending for consideration before the fourth respondent. At that stage, the petitioner approached this Court by filing the present writ petition.

The learned counsel appearing for the fourt respondent submits that in terms of G.O.(Ms.)No.204, Finance (Health Insurance) Department dated 30.06.2022, an internal dispute redressal mechanism was provided and in terms of the same, the petitioner can approach the District Level Empowered Committee for redressal of grievances. He also submits that the said committee is empowered to examine all the factual aspects and then make necessary recommendation to the fourth respondent. He also submits that in case if there is any such recommendation from the District Level Empowered Committee with 3/7

regard to the reimbursement claim made by the petitioner, the same would be considered by the fourth respondent. 4.The learned Counsel for Government submitted that the representation submitted by the petitioner to the sixth respondent was considered by the sixth respondent, who also happens to be one of the members of the District Level Empowered Committee and through the letter in Na.Ka.No.2690802/2026/M2 dated 19.05.2026, the petitioner was required to produce certain documents to enable the District Level Empowered Committee to consider the claim made by the petitioner and the sixth respondent is awaiting for receipt of those documents from the petitioner. A copy of the said letter is also placed before this Court while serving a copy to the learned counsel for the petitioner.

5. The learned counsel for the petitioner, having received the letter dated 19.05.2026, submitted that the petitioner would submit all the necessary documents as required by the sixth respondent expeditiously.

6. In the light of the above, this Court is of the considered view 4/7

that there is an internal dispute redressal mechanism as provided, which appears to be an effective remedy available to the petitioner, it is not open for this Court to entertain this writ petition at this stage. It is also in the interest of the petitioner to approach the District Level Empowered Committee for redressal of his grievances as the said committee has all the powers to examine including the factual aspects as well. 7.In the light of the above, this writ petition is disposed of granting liberty to the petitioner to submit all the documents as required through letter dated 19.05.2026 and on submission of such documents by the petitioner, the sixth respondent shall take all necessary steps for placing the matter before the District Level Empowered Committee and ensure that appropriate orders are passed by the said committee as expeditiously as possible, at any rate, within a period of two months from the date of submission of all the documents by the petitioner.
