PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus directing the respondents to pay the Family pensionary benefits of the petitioner's father (Late) P.Ramasamy, S/o. Puthiyamuthu who served as Divisional Accountant at the 3rd respondent to the petitioner by considering the petitioner's representation dated 28.02.2022. ORDER
By consent of both the parties, this writ petition is taken up for final disposal.
2.The petitioner is a divorced daughter of late employee, P.Ramasamy, who seeks for family pension. Her application in this regard has been kept pending, which prompted her to file the present writ petition. 2/6
3.Today, when the matter was called, the learned Standing Counsel appearing for the second respondent submitted that since the petitioner herein had not enclosed copy of the divorce decree and the copies of the supporting documents issued by the competent Court, they are unable to process the application.
4.The learned Counsel appearing for the petitioner submits that the petitioner is willing to produce the required documents. 5.In this connection, the petitioner is granted liberty to file a fresh rejoinder application enclosing the copy of the divorce decree and any other documents supporting her claim to the fourth respondent herein and on receipt of the same, the fourth respondent shall process the application, within a period of one (1) month from the date of receipt of such application and thereafter, send the proposal to the second respondent herein, who shall consider it atleast within a period of eight (8) weeks from the date of receipt of such proposal from the fourth respondent.
