ORDER

Mr.S.Thangavel seeks permission of this Court to withdraw this civil revision petition with liberty to file a suit on the ground on which he has raised the counter claim. He has also made an endorsement to that effect in the case bundle.

2.In view of the endorsement made by the learned counsel for the petitioner, this Civil Revision Petition is dismissed as withdrawn with liberty as prayed for. As the application seeking the relief of counterclaim itself was not taken up for hearing, the payment of court fee by the defendant would not be of any use to him. Registry is directed to return the Court fee to the defendant. It is up to the plaintiff to work out his rights in an independent suit.
