Respondents Prayer:- Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, directing the 2nd respondent to permit the petitioner to continue as Jewel Appraiser in the 2nd respondent bank in terms of appointment order issued by the 1st respondent in his proceedings in Ref.Zo /TRY/ PAD/ JEWEL/ OR /15/ 2013-14 dated 03.06.2013 by considering the petitioner's representations dated 10.12.2018 and 15.03.2019 within the period that may be stipulated by this Court.

The relief sought for in the present writ petition is to direct the 2nd respondent to permit the petitioner to continue as Jewel Appraiser in the 2nd respondent-Bank in terms of appointment order issued by the 1st respondent.

2. The learned counsel for the petitioner made a submission that the petitioner's services was engaged by the Corporation Bank and the petitioner was continued as Jewel Appraiser. W.P.(MD) No.13291 of 2019 reason and therefore, the petitioner is constrained to move the present writ petition.

The learned counsel appearing for the respondents made a submission that the 2nd respondent-Bank is merged with Union Bank of India and the petitioner was not appointed as a regular employee of the Bank. The services of the petitioner was engaged as Jewel Appraiser on commission basis. The remuneration payable to the petitioner for the jewel loan amount to be sanctioned i.e., at present Rs.2.50 per thousand with a minimum of Rs.25/- per loan. The Branch also executed a special agreement for engaging the Appraisers. The services of the petitioner was discontinued even before the merger of the bank. Subsequently, the 2nd respondent bank was merged with the Union Bank of India.

4. This being the factum, the petitioner is at liberty to submit a fresh application for engaging him as Jewel Appraiser and in the event of receiving any such application, the respondents may consider the same on merits and in accordance with law and take appropriate decision.

5. With the above observations, this Writ Petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
