PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the third respondent to consider and pass orders on the petitioner's representation dated 08.04.2019 within the time stipulated by this Court.

O R D E R

This Writ Petition has been filed for a Mandamus seeking for a direction to the third respondent to pass final orders on the petitioner's representation dated 08.04.2019 within a time frame to be fixed by this Court.

2. The petitioner claims to represent the interest of the Ministerial Technical Loadmen Union. Their grievance is that as per the Government norms, out of 100 Kgs of paddy, 65 Kgs of boiled rice have to be hulled out. But due to breaking of boiled rice and also due to purchase of low standard paddy grains, the expected percentage could not be achieved at time. In such circumstances, the Ministerial Technical Loadmen Union alone are made to bear the loss. They have given a representation to the third respondent on 08.04.2019 to redress their grievance. Since the representation has not been considered, they have filed this present Writ Petition. 2/5

3. A counter affidavit has been filed by the contesting fourth respondent.

Since the representation of the petitioner prior to the filing of this Writ Petition was not considered by the third respondent, this Court is of the considered view that no prejudice would be caused to the third respondent with the petitioner's representation as stated supra is considered on merits and in accordance with law within a time frame to be fixed by this Court. This Court is not expressing any opinion on the merits of the petitioner's representation as well as on the maintainability of the petitioner to give such a representation.

5. For the foregoing reasons, this Court directs the third respondent to pass final orders on merits and in accordance with law on the petitioner's representation dated 08.04.2019 as stated supra within a period of twelve (12) weeks from the date of receipt of a copy of this order.
