PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the learned Judicial Magistrate No.1, Thoothukudi, Thoothukudi District to expedite the trial in C.C.No.277 of 2008 on its file and complete the same within the stipulated time as fixed by this Court.

O R D E R

This petition has been filed seeking a direction to the learned Judicial Magistrate No.1, Thoothukudi, Thoothukudi District to expedite the trial in C.C.No.277 of 2008 on its file and complete the same within the stipulated time as fixed by this Court.

2. The learned counsel for the petitioner submits that initially a case is registered in the year 2008 in Crime No.2 of 2008 on the file of the second respondent police as against 10 known and 10 unknown persons. After completion of investigation, final report came to be filed for the offences under Sections 147, 447, 427, 353, 506(i) IPC. It is submitted that the case is pending for more than a decade and the accused are appearing in the court for the past 13 years as well. Hence, the learned counsel prays for early disposal.

3. Heard both sides.

Considering the submission of the learned counsel for the petitioner and considering the fact that initially the case is registered in the year 2008, this Court issues a direction to the learned Judicial Magistrate No.1, Thoothukudi, Thoothukudi District to expedite the trial in C.C.No.277 of 2008 on its file and to https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.9514 of 2021 complete the same within a period of three months from the date of a copy of this order.

5. In fine, this petition is disposed of.
