ORDER : The Court made the following order :- The petitioner/Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 324, 341, 379(NP) and 506(ii) I.P.C r/w 4 of Tamil Nadu Prohibition of Harassment of Women Act, in Crime No.73 of 2022 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that due to matrimonial dispute between the husband and wife, on 03.06.2022 at about 06.00am, the accused took away the defacto complainant's earrings apart from money. Hence, the complaint.
3. Today, when the matter is taken up for hearing, the petitioner and the defacto complainant appeared before this Court and the defacto complainant would submit that the petitioner herein had illegal contact with one of his relative and the same was warned by the defacto complainant. Later the petitioner married another woman and now he is residing along with her. The petitioner would submit that so far no second marriage is performed by him. https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.10279 of 2022 4.From the above, the conduct of the petitioner shows that he is not taking care of the defacto complainant and also changing his life partner from time to time, due to which, the present occurrence took place. Considering the character of the petitioner and the facts and circumstances of this case, this Court is not inclined to grant anticipatory bail to the petitioner and it deserves to be dismissed.
5.Accordingly, this Criminal Original Petition stands dismissed.
