PRAYER :- For Bail in Crime No.403 of 2016 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused herein, who was arrested on 31.03.2022, in pursuant to the execution of NBW issued by the learned Judicial Magistrate No.I, Pudukottai, in Crime No.403 of 2016, on the file of the respondent police, for the alleged offence under Sections 147, 148, 294(b), 341, 302 IPC, seeks bail. 2.The petitioner was arrested and remanded on 31.03.2022, on execution of warrant, which was issued on 18.01.2022. In PRC No.32 of 2017, there are totally 18 accused and this petitioner is arrayed as 14th accused.

3. From the B-Diary submitted by the lower Court it is seen that though the crime is of the year 2016, final report also filed in the year 2016 and the same was taken on file in the year 2017 as PRC No.32 of 2017, still now, the case is pending for committal process, since one or other accused are continuously absconding. CRL OP(MD). No.12984 of 2022 4.In view of the above, the learned Judicial Magistrate No.I, Pudukottai is hereby directed to split up the case, against whom are in custody and complete the committal proceedings within a period of one month, from the date of receipt of a copy of this order. The petitioner can revive his bail petition after the completion of committal proceedings.

5.Accordingly, this Criminal Original Petition stands dismissed.
