This Criminal Appeal is filed under Section 14(A)(2) of the Schedule Castes and Tribes Prevention of Atrocities Act,2015(Amended by Act 1 of 2016),to call for the 1/4
records pertaining to the order passed in Crl.M.P.2534 of 2023 on the file of the Special Court for Exclusive Trial Cases under SC/ST(PoA)Act, Sivagangai dated 28.12.2023 and set aside the same as illegal and enlarge the appellant on bail by allowing the appeal.
ORDER:- This Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr. R.Manickaraj, Advocate for the Petitioner and of Mr. M.Muthumanikkam, Government Advocate for the R1 and R2, this Court made the following order: "This Criminal Miscellaneous Petition has been filed to relax the condition imposed on the petitioner while granting bail to the petitioner in Crl.A.(MD)No.25 of 2024.
2.The learned counsel for the petitioner would submit that the petitioner has complied with the Conditions imposed by this Court regularly. 3.The learned Government Advocate (Criminal Side) would submit that the petitioner is complying with the conditions imposed by this Court regularly. Further, the investigation is completed and the final report is filed and the same was taken on file in Crl.M.P.No.2534 of 2023 dated 28.12.2023, on the file of the learned Special Court for Trial cases under SC/ST(PoA) Act, Sivagangai. 2/4
4.Considering the said submission, the condition imposed as against the petitioner is relaxed and the petitioner is directed to report before the respondent police as and when required for interrogation."
