Mr.B.Thanga Aravindh, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.148 of 2024 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioner, apprehending arrest at the hands of the respondent Police, in connection with a case in Crime No.148 of 2024, for the offence punishable under Section 25(1B) (a) of Arms Act, has filed this petition seeking anticipatory bail. 1/3
2.The case of the prosecution is that on 14.03.2024, the first and second accused were found with possession of country made Pistol with six unused cartridge and one used cartridge without any valid license, which are procured from the petitioner. Hence the case.
3.The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioner. 4.The learned Government Advocate (Crl.Side) appearing for the respondent Police submits that the first accused in his confession statement stated that the country made pistol was bought from one Satish and on investigation it was found that the said Satish has bought the same from the petitioner herein. 5.Considering the rival submissions made, earlier this Court has granted interim anticipatory bail to the petitioner with a direction to appear before the respondent police and co-operate for the investigation. Accordingly, the petitioner has also appeared before the respondent police on 19.06.2024. 6.
Today, the investigation Officer has filed a report stating that during the course of investigation, he has taken the petitioner to his residence and found that the petitioner is having a lathe, which is almost like an armory. He has also taken photos of the same and placed it before this Court.
has also collected materials as that the petitioner is involved in a similar case in Crime No.721 of 2023, which was registered on 13.10.2023.
7. Considering the nature of offence, antecedent of the petitioner and the materials placed before this Court, this Court is not inclined to grant any relief to the petitioner.
