This writ petitioner filed this Writ Petition seeking for issuance of a Writ of Mandamus, directing the respondents to consider the representation of the petitioner dated 19.05.2022 and to give police protection to the life and limb of the petitioner and his family members and to enable them to enjoy the subject properties in Survey Nos.193/1, 194/3, 198/4, 191/3B, 191/5B, 192/1A1A, 192/2C1, 198/1A1A, 189/2A and 191/4A1, Thirukostiyur Village, Thiruppathur Taluk, Sivagangai District and Survey Nos.38/3B, 41/1, 41/5A and 41/5B, T.Vairavanpatti Village, Thiruppathur Taluk, Sivagangai District.
2. The learned counsel for the petitioner submitted that the petition mentioned property belongs to the petitioner's family and since the accused are interfering with their possession, the https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P(MD)No.11697 of 2022 petitioner's father filed a suit in O.S.No.252 of 1992 before the District Munsif Court, Sivagangai District against the defendants therein praying for a decree of permanent injunction. The suit was decreed in favour of the petitioner's father. Inspite of the decree, the defendants giving trouble and they are in enjoyment of the property of the petitioner. Hence, he seeks police protection by giving representation to the respondent police on 19.05.2022. Since the respondent police did not take any action thereon, the present Writ Petition has been filed.
3. The learned Government Advocate (Crl.Side) submitted that there is a dispute between the petitioner and the private parties and the petitioner's representation is under enquiry.
4. Recording the submission made by the learned Government Advocate (Crl.side), respondent police is directed to consider the representation of the petitioner, dated 19.05.2022, and if any cognizable offence is made out, the respondent police shall conduct an enquiry and proceed further and to take appropriate action.
5. With the above direction, this Writ Petition is disposed of. No costs. Consequently, the connected Miscellaneous Petition is closed.
