The Writ Petition has been filed in the nature of a Mandamus seeking a direction to the first respondent /Zonal Deputy Tahsildar, Manachanallur, Trichy, to transfer patta No.452 to the names of all the three legal heirs of the deceased Karupayee with respect to the lands measuring 0.9.50 Ares in Survey No.243/7, Sunipuganallur Village, Thirupanjili South, Manachanallur Taluk, Trichy District. The petitioner had given an application on 17.03.2023.
2. Mrs.D.Farjana Ghoushia, learned Special Government Pleader who had taken notice for the respondents stated that the 2/5
application of the petitioner had been rejected by the first respondent on 24.04.2023. A copy of the order has also been produced.
3. It is seen that the petitioner has not produced any document to show that he is the legal heirs of the deceased Karupayee. The petitioner may file necessary appeal as against the said order before the Appellate Authority and produce necessary documents and if it is produced, the Appellate Authority may consider the same in the manner known to law. However, the writ petition cannot be considered. The writ petition stands dismissed, giving liberty to the petitioner to file necessary appeal. If the appeal is filed on or before 15.06.2023, then the issue of limitation may not be put against the petitioner herein. No costs.
