Respondents PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to shut down the shutter of Ponnani River Dam situated at Mugavanoor Village, Manaparai Taluk, Trichy District and consequently, to direct the 2nd respondent to convene a meeting along with representatives of beneficiary villages to fix suitable and conductive period to release the water for optimum utilization.

ORDER

[Order of the Court was made by J.NISHA BANU, J.] By consent of both parties, this Writ Petition is taken up for final disposal at the stage of admission itself.

2.The petitioner seeks a direction to the respondents to shut down the shutter of Ponnani River Dam situated at Mugavanoor Village, Manaparai Taluk, Trichy District and consequential direction to the 2nd respondent to convene a meeting along with representatives of beneficiary villages to fix suitable and conductive period to release the water for optimum utilization. 3.Mr.P.Thilak Kumar, learned Government Pleader, who takes notice for the respondents, submits that the water is released only as per the Government Order issued in this regard.

4.In view of the said submission, we are of the view that since the Government has framed guidelines by way of Government Order for releasing the water stored in the dam, we are not inclined to pass any orders in this regard. Accordingly, this Writ Petition is dismissed. If at all the petitioner is aggrieved, he can challenge the Government Order in the manner known to law. No costs.
