ORDER

The accused persons have filed the present petition seeking to quash the F.I.R. in crime No.54 of 2025, on the file of the first respondent, wherein the petitioners are alleged to have committed offences under Sections 49, 87 of BNS, 2023 and Section 9 of Prohibition of Child Marriage Act.

2. A perusal of the FIR reveals that the first accused is alleged to have abducted the minor girl, tied a thali, and claimed that he had married her. The first petitioner filed a bail petition in Crl.M.P.No.584 of 2025 before the Principal Sessions Judge, Dindigul, and he was enlarged on bail. The father of the minor child/de-facto complainant has appeared before this Court and filed an affidavit stating that, due to a land dispute, he was under the impression that the first accused had abducted his daughter. However, there is no connection between the accused persons and the alleged occurrence. It is relevant to extract the affidavit as follows:

''AFFIDAVIT FILED BY THE DEFACTO COMPLAINANT I, A.Ananthan, S/o.Appanayakkar, aged about years residing at Pungamadaipatty, D.Gudalur Village, Guziliamparai Taluk, Dindigul District do hereby solemnly affirm and sincerely state as follows: 2/6

1. I am the De-facto Complainant and 2nd respondent herein and as such I am well acquainted with the facts and circumstances of the case.

2. I submit that the petitioners is a close relative to me. I lodged the complaint against the petitioners to the 1st respondent. The said complaint was registered in Impugned FIR. So been during the pendency of investigation of the said FIR, the petitioners filed present quash petition before this Hon'ble court.

3. I submit that Due to the land dispute pending between us, on the date my daughter (the victim girl) went missing, I assumed that the accused persons were responsible for her disappearance. Hence, I lodged a false Complaint against the petitioners. However, based on the advice of respectable persons of my locality and my family members, I have now decided to settle the issue amicably with the petitioners. Due to that I agree to withdraw my complaint in the best interests of my child. This compromise has taken place purely with an intention to settle the dispute amicably and the compromise was arrived purely voluntarily. I signed in the Compromise Memo filed before this Hon'ble Court voluntarily and without any coercion. I am fully agreed to quash the FIR, no one compel me to sign in the Compromise Memo.

4. I submit that I want to withdraw the complaint I lodged the complaint against the petitioners some misunderstanding. So I decide want to withdraw my complaint. Therefore I agree that I have no objection to quash this FIR before this Hon'ble Court. 3/6

It is therefore prayed that this Hon'ble Court may be pleased to accept this Affidavit and to pass such further or other orders as this Hon'ble Court deems fit and proper in the circumstances of the case and thus render justice.''

3. In view of the above facts, it is clear that no marriage took place between the first accused and the minor child, and no POCSO case has been made out against the first petitioner. In such circumstances, the de-facto complainant and the accused persons have entered into a compromise, wherein the defacto complainant has agreed to the quashing of the FIR.

4. Today, the defacto-complainant is present in person and he acknowledges the fact that he had agreed for quashing of the FIR.

5. In view thereof, this Criminal Original Petition is allowed and the FIR in Crime No.54 of 2025 on the file of the first respondent police is quashed. The joint compromise memo shall form part and parcel of the order. Consequently, connected miscellaneous petition is closed.
