ORDER
The petitioners/A5 and A6 have filed this petition to quash the Crime No.120 of 2021, pending on the file of the first respondent police, wherein they are said to have committed the offence under Sections 147, 448, 427, 294 (b), 323, 379 and 506(i) IPC.
2. The case of the Prosecution is that the 2nd respondent herein has given a complaint alleging that on 31.03.2021, when she was at home, all the accused persons have come in a vehicle bearing Registration No.TN 69 BF 3279 and they have trespassed into her house and the first accused said to have slapped her due to which she fell down and the first accused have abused her in filthy language. It is further alleged that the first accused have taken away cash of Rs.48,000/- and 25 sovereigns of gold Page No.2/5
and some documents. It is further alleged that all the accused have broken this CCTV camera installed in her house and also threatened her with dire consequences. Hence the complaint.
3. When the matter is taken up for hearing today, the learned Government Advocate (Criminal side) submitted that after completion of investigation, final report has been filed before the learned Judicial Magistrate, Eraniel, on 13.07.2020 and the same is yet to be taken on file.
4. Recording the submission made by the learned Government Advocate (Criminal side), this Criminal Original Petition stands closed with liberty to the petitioners to work out their remedy in the manner known to law.
