ORDER

(Order of the Court was made by N. ANAND VENKATESH,J.) This Habeas Corpus Petition has been filed for a direction to the respondent Nos.1 to 3 to secure and produce the body or person of the petitioner's daughter and to set her at liberty.

2. Heard the learned counsel on either side.

3. The case of the petitioner is that the marriage of his daughter was fixed on 06.04.2026 and all arrangements were made. However, on 05.04.2026, the petitioner's daughter went missing and thereafter, the petitioner's family were not able to trace her. Under such circumstances, a complaint came to be given before the third respondent, based on which a

woman missing FIR has been registered in Crime No.105 of 2026. Since no effective steps were taken to trace the whereabouts of the detenu, the present Habeas Corpus Petition has been filed.

4. The learned Additional Public Prosecutor on instructions submitted that the detenu had a love affair with one Sarathy and she has eloped with him.

5. Taking into consideration the facts and circumstances of the case and the nature of the grievance expressed by the petitioner and considering the submissions made by the learned Additional Public Prosecutor, there shall be a direction to the third respondent to produce the detenue before the learned Judicial Magistrate, Nilakottai. On the date of her production, the petitioner shall be put on notice. The learned Magistrate shall record the statement of the detenue and proceed further in accordance with law.
