To transfer the investigation of the complaint with CSR No.21/2022 from the file of 4th Respondent to the file of 2nd Respondent and consequently direct R2 to conduct proper investigation in an expeditous manner for conducting investigation along with the Crime No.4/2021 Prayer in CRL OP(MD). 18053/ 2022 :

Criminal Original Petition filed under section 482 of Cr.p.c. To transfer the investigation of the case in Cr No.33/2022 from the file of the 4th Respondent to the file of the 2nd respondent and consequently direct the 2nd Respondent to conduct proper investigation in an expeditious manner for conducting ORDER:- These Petitions coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.B.Nambi Selvan Additional Public Prosecutor for the Petitioner,and of None appeared for the Respondent this Court made the following order: These petitions have been filed to extend the time for a further period of three months to complete the investigation and to file the final report as per the directions given by this Court, by its order, dated 08.02.2023, in Crl.M.P.(MD).Nos.2131 and 2138 of 2023 in Crl.O.P.(MD)Nos.18052 and 18053 of 2022.

2. The learned Additional Public Prosecutor would submit that so far 16 witnesses were examined and out of nine accused, five accused were arrested and four accused yet to be arrested. Because of waiting for Forensic Lab report, the investigation could not be completed and hence, seeking for extension of time for completing the investigation.

3. In view of the above said submission made by the learned Additional Public Prosecutor, investigation is almost over and the Lab report has to be received, hence, time is extended for a period of three months from the date of receipt of a copy of this order, for completing the investigation and file final report before the concerned Court.

4.Accordingly, these Criminal Miscellaneous Petitions are allowed.
