Petition filed under Section 24 of the Code of Civil Procedure 1908, to withdraw the case in H.M.O.P.No.96 of 2016 pending on the file of the Family Court, Tirunelveli and transfer the same to the Family Court at Madurai or any other competent court at any other District except Family Court, Tirunelveli within the time stipulated by this Court.

ORDER

The wife seeks transfer of H.M.O.P.No.96 of 2016, pending on the file of the Family Court, Tirunelveli to the Family Court, Madurai.

2.None appears for the petitioner.

3.Mr.K.Navaneetha Raja, learned counsel appearing for the respondent would submit that H.M.O.P. No.96 of 2016 itself has been disposed of by the Family Court, Tirunelveli and the petitioner-wife has also filed an appeal against the said order before this Court.

4.In view of the above said submission made by the learned counsel for the respondent, the Transfer Civil Miscellaneous Petition is dismissed. No costs. Consequently, C.M.P (MD)No.10179 of 2016 is closed.
