PETITION FOR ANTICIPATORY BAIL Under Section 438 of Cr.P.C. PRAYER :- For Anticipatory Bail in Crime No.162 of 2024 on the file of the Respondent police.

ORDER : The Court made the following order :- 1/3

The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 8(C) r/w 20(b)(ii)(B) NDPS Act, 1985 in Crime No.162 of 2024 on the file of the respondent police, seek anticipatory bail. 2.The case of the prosecution is that the accused persons were found in illegal possession of 20.250 kgs of ganja. Hence, the complaint. 3.The learned counsel appearing for the petitioners would submit that the petitioners are innocent and they have not committed any offence as alleged by the prosecution. He would further submit that only based on the confession statement, the petitioners herein were implicated as accused. 4.The learned Government Advocate (Criminal Side) appearing for the respondent police would submit that the contraband seized from the accused is a commercial quantity.

That apart, the first petitioner herein is having two previous cases, in which, one case is similar in nature and the second petitioner is having five previous cases, which are similar in nature. He would further submit that the investigation is still pending. Accordingly, he prays to dismiss the present petition. 5.It is seen that the contraband involved in this case is 20.250 kgs, which is commercial quantity and the petitioners herein are having similar previous cases.
