W.P.(MD)No.13621 of 2019 BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED:12.04.2022
CORAM:
THE HONOURABLE MR.JUSTICE S.M.SUBRAMANIAM W.P.(MD)No.13621 of 2019 and WMP(MD) No.10172 of 2019 C.Balakrishnan ... Petitioner Vs.
The General Manager The Tamil Nadu State Transport Corporation (Madurai) Ltd., Dindigul Region, Bypass Road Dindigul ... Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of a writ of Mandamus to direct the respondent to keep vacant 18 posts in the respondent corporation for the employees who are working under daily rate wages.
For Petitioner : Mr.G.M.Xavier For Respondent : Mr.J.Senthil Kumaraiah
ORDER
The relief sought for in the present writ petition is to direct the respondents to keep 18 posts vacant in the respondent corporation for the employees, who are working under daily rated wages.
2.The relief sought for in the present writ petition is absolutely misconceived. A daily wage employee cannot file a writ petition seeking a direction to keep 18 posts vacant. Thus, the petitioner has not established even a semblance of legal right for the purpose of entertaining the relief in the writ petition. Accordingly, the writ petition stands dismissed. No costs. Consequently connected Miscellaneous Petition is closed. Sd/- Assistant Registrar (CS-I) // True Copy // / /2022 Sub Assistant Registrar(CS) RR https://hcservices.ecourts.gov.in/hcservices/ 1/2
