PRAYER :- For Anticipatory Bail in Crime No.Not known of 2024, on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioner, apprehending arrest at the hands of the respondent Police, in connection with a case in Crime No. Not Known of 2024, for the offences punishable under Sections 406 & 420 of IPC, has filed this petition seeking anticipatory bail.
2. When the matter was taken up for hearing, the learned Government Advocate(Crl.side) appearing for the respondent submitted that based on the complaint given by the defacto complainant against the petitioner, an enquiry has been initiated and the same is pending. It is further represented that till the enquiry is completed, the respondent police will not arrest the petitioner.
3. Recording the above submission, this criminal original petition is closed with a direction to the petitioner to co-operate with the respondent Police for the enquiry. It is made clear that till the enquiry is completed, the respondent Police shall not arrest the petitioner. The guidelines stipulated for preliminary enquiry or registration of FIR by the Hon'ble Supreme Court in Lalita Kumari Vs. Government of Uttar 2/3
Pradesh and others [2014 (2) SCC (1)] shall be strictly adhered to by the respondent police. However, if the petitioner fail to co-operate for the enquiry, the respondent Police is at liberty to arrest the petitioner. Liberty is also granted to the petitioner to file a fresh anticipatory bail petition or bail petition as and when such need arises for them in the near future.
