under Section 483 of Bharatiya Nagarik Suraksha Sanhita (BNSS) praying to grant bail.

2. The petitioner / sole accused, who was arrested and remanded to judicial custody on 17.02.2025 for the alleged offences punishable under Sections 7 and 25 (1A) of Arms Act, 1959 in Crime No.20 of 2025, on the file of the respondent police, seeks bail.

3. The case of the prosecution is that on 17.02.2025 at about 7.30 hours, when the respondent - Police was in routine check up in Namanasamukthiram, Ilangudipatti amd Melathemuthupatti Villages, at that time, the petitioner herein is roaming in the public road with country made gun and shouted against the public. Hence, the case.

4. Mr.Na. Palaniyandi, learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and a false case has been foisted against the petitioner. He would further submit that the petitioner has been in judicial custody from 17.02.2025 and seeks bail.

Per contra, Mr.R.Meenakshi Sundaram, learned Additional Public Prosecutor appearing for the respondent Police, submits that there are 17 previous cases pending against the petitioner and he is a habitual offender. He further submits that he was detained under Act, 14 of 1982. He further submits that the country made gun was recovered from the petitioner. He further submits that if the petitioner is released on bail, he may cause threat to the general public. Hence, he opposed the grant of bail to the petitioner.

6. Heard both sides and perused the records.

7. The petitioner has 17 previous cases and he was detained under Act, 14 of 1982. In view of the previous bad antecedents of the petitioner, this Court is of the view that if the petitioner is released on bail, he will commit the similar nature of offence again and thereby, cause much trouble to the general public. Hence, this Court is not inclined to grant bail to the petitioner. 3/4
