ORDER

This petition is filed to withdraw and transfer the case in HMOP.No.236 of 2016 pending on the file of the Sub Court at Thoothukudi, preferred by the respondent herein and transfer the same to the Family Court, Virudhunagar.

2. The respondent, who is the wife of the petitioner herein, has filed HMOP.No.236 of 2016, on the file of the Sub Court, Thoothukudi, for divorce. Now, the petitioner / husband has filed the present Transfer Civil Miscellaneous Petition to withdraw and transfer the case in HMOP.No.236 of 2016 pending on the file of the Sub Court at Thoothukudi, to the Family Court, Virudhunagar.

3. When the matter was taken up for hearing the learned counsel appearing for the petitioner without insisting upon the prayer sought for in this petition, seeking for direction to the learned Subordinate Judge, Thoothukudi, to expedite the proceedings in HMOP and the learned counsel appearing for the respondent has also accepted the same.

4. In view of the said submission made by the learned counsel appearing on either side, this Transfer Civil Miscellaneous Petition is closed. However, the learned Subordinate Judge, Thoothkudi, is directed to dispose the HMOP.No.236 of 2016, pending on his file, https://hcservices.ecourts.gov.in/hcservices/

within a period of two months from the date of receipt of a copy of this order. No costs. Consequently, the connected Miscellaneous Petition is closed.
